The US FCC Begins Process to Restore Net Neutrality Regulations

Five years after the elimination of net neutrality regulations in the US, FCC chairwoman Juliana Rosenworcel has initiated the process to bring them back. Rosenworcel believes that restoring the FCC’s authority over broadband service is necessary to ensure that the internet remains open, fast, fair, safe, and secure.

The concept of net neutrality, which requires treating all data equally and prohibits ISPs from throttling speeds or blocking access based on content, was introduced in the early 2000s. In 2015, the Open Internet Order was enacted to enshrine net neutrality into law during the Obama administration. However, in 2017, under President Trump, the FCC voted to dismantle these regulations.

The FCC’s decision to end net neutrality was controversial as it broke along party lines with a 3-2 vote. Many organizations, including the ACLU, EFF, Google, and smaller internet providers, as well as the general public, opposed this move. In response, some US states like California, New Jersey, and Oregon implemented their own net neutrality regulations, defying the FCC.

The momentum to restore net neutrality grew in 2021 when President Joe Biden signed an executive order to encourage the FCC to reinstate the rules. This effort was further bolstered by the appointment of Rosenworcel as FCC chair, replacing Ajit Pai, who led the push to end net neutrality.

Although net neutrality has not yet returned, progress is being made. The FCC is proposing initial procedural steps to reaffirm rules treating broadband internet as an essential service for Americans, comparable to water, power, and phone services. The pandemic highlighted the importance of reliable internet access for work, healthcare, education, and commerce.
